    I didn’t say there WERE lessons to be learned.. I said that I wonder if we have looked at the situation to see if there were lessons that COULD be learned. That would seem at least a sensible and prudent and mature way of reviewing the situation. Like you and everybody else on here, I lay the blame firmly at Silva’s door. He behaved very badly. And yes it was an unusual occurance. But could we learn lessons about the due diligence we carry out on future appointments? Do we underpay our Head Coaches? (The Joka episode too if we actually believe he left because of salary issues). Communication between owner and Head Coach over transfers, both incoming and outgoing. Etc. Only those directly involved could ever know.

    I think them appointing him is better for our case than if they went for someone else. But the chances of a private settlement look slim now. I guess now it's up to Gino whether he wants to give the ok for a push to get a PL tribunal to hear his case.

    Not if we get rid of Gomes or he’s unhappy at not being No.1. I think a lot of his happiness stems from starting games. And no way on earth does Gino depreciate a valuable commodity like Richarlison by sitting him in the reserves for 2 years. He’d sell him straight off if he kicked up a major fuss.

    He has no choice, he has to try every avenue open to him. He has a duty to protect the club.

    By refusing to give them Silva last year, we inflicted Allardyce on Everton for six months.

    Maybe that’s punishment enough.

    It depends on the evidence we have and the chances of winning. It would just compound the issue if we turned down their original offer, then sacked him anyway, they get him for nothing, and we then lose a tribunal claim after a time consuming action.

    Given there will be significant costs involved if we lose, he'll have to balance potential rewards against that. It's not a free hit. There's a risk and like every business owner he'll have to weigh things up. There's certainly a choice.

    That's true, there's always a financial risk, but on this occasion I don't think he has a choice. The EPL has to get involved. I'm not sure why they are so reluctant. There's clearly wrong-doing here, everyone can see it. Justice has to be seen to be done. I know Watford get a bad rap, but for the good of football and for the protection of smaller clubs, I don't think he has a choice.

    Do nothing then Everton have got away with their dirty tricks. I'm not sure that would sit well with Gino.

    I have suspected for a few weeks now that we’d get nothing out of this. The PL rules almost allow stuff like this to happen with little to no punishment.

    Either way, I think it’s important that the club says something as it’s crucial that we don’t look a soft touch as the vultures will soon circle. You’d have to guess that Everton and their lawyers are pretty sure of their cards if they’ve plowed on and appointed him before any agreement has been made with us.

    Not sure if you saw it but I explained this earlier in the thread.

    Short version - it's a dispute between clubs and the PL aren't a party to it. They do however mandate the mechanism for clubs to resolve disputes.

    At least we can all look forward to him doing really well and watching the Everton fans go into meltdown when he wants to leave for a big club, or him crashing and burning and his career going up in flames.

    I agree, he will either jump ship, or be sacked. There's no way he will stay for 3 years. What goes around, comes around. There will be payback for Everton on this somewhere down the line.

    In what capacity? The initiative is with Watford. And we've clearly not asked for a formal hearing yet.

    It's the PL AGM soon. That will be an opportunity for bigwigs from both sides to talk.

    I understand that’s how it would work if you were in dispute over airline compensation. Or any such thing. But is that definitely true of the PL rules? Not saying it’s not but I’d be interested to know. Because if so, EFC could have effectively printed a two page spread in the National Press imploring Silva to join them and have photos of Moshiri meeting Silva and his agent - and still the PL would only ask that we discuss it between ourselves? Surely if rules are broken and we have evidence, they can just get involved straight away? I don’t understand the delay and apparent hand-wringing and dragging of heels from them?

    What do you mean, in what capacity? Watford have already asked the PL to get involved and they said they would rather the clubs sort it out between the two of them. I maybe jumping the gun here, but that doesn't appear to be happening. So Watford have to ask the PL again and take it as far as they can.

    There is clearly evidence of the Everton pursuit, the cease and desist notice, the collapse of form and Silva now being appointed as the Everton coach. I'm sure there is a lot more the club could dig up as evidence.

    I’d suggest it’s because they are not an independent body there just to look into wrong doing, it’s their own product and they’d rather avoid having to do anything about it if they possibly can.
     
  21. A statement from the Club right now would be pointless and would achieve nothing. If the matter is now being discussed legally, why say any more and jeopardise the case with loose words or comments that can be quoted in court? We did not have to come to any agreement with Everton before they signed him, but it would have been more beneficial for them if we had. His contract was cancelled and he is a free agent. The legal case could take months, and right now, they need their head coach for next season (or the first four months anyway) in situ.

    Having a tilt at Everton or Silva right now would not prevent us from looking like a soft touch; it is more likely to show us up as being petty and insecure, which, unfortunately, is exactly how some, but far from all, of the comments on this forum will be translated.

    The ****** is gone, and like many Watford fans, I don't give a damn what happens to him; I suspect that would upset Sliva, Everton and their fans far more than words of defiance. And when they do finally get the bill, and I believe it will be hefty and possibly punitive (if they are shown to have not taken mediation seriously), we can let the legal system do the talking.

    That said. I am very much looking forward to the Vic being full of rubber snakes.

If it was agreed as part of any reparation and incorporated into a contract it would be enforceable in the sense that they could be sued for breach of contract, and if they did break such a contract, it is very likely that the PL, FA and possibly UEFA would frown on such unethical subversive behaviour by a member club.

    I know. But what are the point of the rules if they would ‘rather not’ enforce them?

    As I understand it, we made a complaint at the turn of the year - the PL then said they would rather we discussed it ourselves and they would get involved if deadlock was reached. As the media has said, Kenwright gave word that Silva would not be appointed as Everton boss this summer. If true, why make that assurance? Surely it would be an agreement made by Kenwright in the face of some sort of evidence of impropriety? We may have been happy to have let the case rest on that if it had stuck. But the minute it became clear they were going to appoint him this summer, the news broke that we’d lodged a complaint. It’s at this point I think we have asked the PL to adjudicate as negotiations have broken down and become deadlocked. That’s how it’s been reported as far as I can see.

    So EFC have called our bluff on the issue or are confident the PL will do nothing. I fear they are correct on the latter.

    It's interesting that the club have made no statement as yet , this leads me to believe it's either all over and we have rolled over or that now silva in place the legal case will start (forcing EPL to adjudicate it's own rules and regs ).

    I wouldn't concern yourselves with us coming after any of your players

    Three reasons why...

    1) You wouldn't sell us any of them anyway

    2) Silva has v little say on transfers. The new DoF is in charge of this now. Unlike with Koeman and Walsh where there had to be agreement on deals, in this structure Silva has minimal input

    3) Everton are changing their transfer policy this summer. There's an acceptance that we've been absolutely fleeced for some players who were little better than what we had, so our new DoF has suggested that the focus will be on buying younger players, probably where we can see better value in the market. That will exclude a lot of The Premier League in all honesty, especially people like Richarlison who'd cost £40m+ (although point number one would make that irrelevant anyway).

    I hope the 1881 are already designing a visual to welcome Snake back to the Vic. It’s the first fixture I’ll be looking out for that’s for sure

    Trouble is this is almost in the territory of match fixing , not happy you can’t leave and go to one of your rivals so perform crap get sacked and then join them later.

    You can also see why the PL don’t want to go involved , if there was a way of proving (which I doubt you could) that Silva was intentionally underperforming that would open a rather large can of worms for the PL and Everton

    Would personally think PL will put a lot of pressure on Everton to make good with Watford , would also guess that most clubs wouldn’t be happy about the precedent this could set if not settled in our faviour.

    Just think for the first time in years we are the good guys

    We need to move on and get our players and tactics sorted for next season. If we can get a few £m compensation for low effort then great but that really shouldn't be the main focus now. Who are we selling and who are we buying is what matters.
