Refunds Due To Covid

    Anybody in the travel or leisure sector that can give a bit of advice?

    Put a deposit on a house for my daughter and 20 friends to go to to celebrate her 21st in December which they obv can’t do now. Company saying that they can still supply the house so will only offer me a credit to use next year. I want deposit repaid

    Also put a deposit on a Christmas holiday to a country that’s now on the governments no fly list. Company saying that I either lose my deposit, have a credit note next year or pay the balance and, two weeks before holiday, apply for a refund in full. I just want my deposit back

    I get it’s a negotiation and I feel very sorry for these companies but I will be damned if I can find any legislation for the two scenarios above

    Anyone know?

    If you paid by credit card and have no luck getting them to return your deposits, I would contact your card company!

    Did you book before Covid was a thing?

    travel insurance doesn’t cover cancellation as both were booked in about April when covid was a thing but should only last a couple of weeks

    I fear that you are possibly stuffed on the house deposit if there is no specific legal reason why you can not attend personally. The owners would not likely be liable for your inability to use it the way the rental was originally intended. I'd go and treat it as a holiday tbh. A change of scene if nothing else.

    With regards to the holiday the sticking point may be that it was booked whilst the virus was known about which might kill off any insurance claim although if it is government legislation that is preventing you attend then there should be recompense.

    As already said booking deposits on credit card gives you an extra level of protection.

    Surely the 'rule of six' is a reason? The booking was for 20.

    Possibly, but there's nothing stopping 6 people using it or indeed a bubble of 20 (bit of a stretch) and as such the owners are able to fulfill their part of the contract. WAs it one booking for the house or 20 separate ones? Check the T&Cs agreed to when the deposit was paid also.

    You really need to get proper advice though, I'm only giving an educated guess based on limited contract law knowledge. Moneysavingexpert should really be your first port of call. C&P below

    WillisWasTheWorst Its making less grammar mistake's thats important

    On the holiday abroad: if the country is still on the no-fly list shortly before the departure date, the flight will not happen and you are certainly entitled to a refund for the flight. (We have done this twice this year with BA with no problem.) I assume the same would apply to the rest of the 'package' if you have bought one. However, the advice in these situations is always not to pay the balance if it is uncertain whether the holiday will go ahead.

    Re the house booked of your daughter's party, put your claim for a refund in writing. If they fail to respond or decline your request travel to the property in the small hours with a can of petrol (or other flammable liquid) and some matches. Then set fire to it

    Thanks for the responses...it seems there are no clear guidelines in my situation

    re holiday - there is huge ambiguity if you’ve only paid a deposit and not paying the balance. If I pay the balance and the holiday can’t happen then they will refund you within three months of the company cancelling but the company may go under and don’t want to pay more money

    re house - as people have said the argument is that they can still supply the property albeit for 6 rather than 20. They have come back and offered 50% refund and 50% credit that I may well take

    I doubt many of us predicted the fall out that covid would create back in feb/March when it first broke
