  6. Great thing about this is that Everton are our best witnesses in this, and have provided the strongest evidence for their culpability and the financial value of our losses.

    It seems clear they are keen for it to go to the PL tribunal hoping that less damages are awarded than we are asking for*. With the £1m offer they are presumably hoping to drag any pay-out downward, as well as to persuade an ill-informed punditry and fan base that they have acted reasonably (most pundits or fans seem to think football is exempt from law). Having seen Gino deal so well with court actions so far (make no mistake, he owned the 'dodgy letter' case by accepting responsibility on behalf of the club, allowing full oversight of our accounts, and making no complaint about the fine, rather than fighting it and getting a points deduction plus fine), we can be sure that when he speculates damages, it will be a reasonable figure that will not cause anyone in judgement to speculate that he was chancing his arm for a higher pay-out. Watford fans have seen for themselves that Gino doesn't f-about like Moshiri appears to be doing, and when he goes down a legal route, he knows exactly what he is doing, what the risks are, and very importantly, when to hold up his hands and say mea culpa.

    It is clear that we considered Sliva to have breached his contract, which, if you understand what that entails, means we believe Sliva has no right to compensation (because he was the first to reject the contract). It also served as a warning to Sliva and Everton that we were the injured party, and therefore entitled to claim compensation from them (that is how contract law works).

    The beauty is that where we would originally be claiming compensation based on our own speculation of his worth (based, no doubt, on the fact we rejected a reportedly 12-15 million offer for him), we can now, with Everton once again interested in him, legitimately use the scouser's own valuation as the solid baseline for any compensation claim.

    If they say he may have turned out poop anyway, we can say their current interest in him agrees with our speculation, from the Club's statement on his sacking, that he was a good manager affected directly by the tapping up. He has done nothing since his sacking to indicate he is a better manager than when we ditched him, so anyone judging Everton's opinion of him can easily perceive that they rate him the same now as when they made their offers for him, and therefore they now dictate the minimum compensation they thought was reasonable for the loss of his services. Everton, and Sliva himself, may also be susceptible to payment of other damages for the harm done to the club, as (shrewdly) mentioned in the statement, by his drop off in performance as our coach.

    Any negative statement they make about damages being mitigated by the possibilities that he wasn't as good a manager as we claim him to be (if we had said he was poop, we would have talked ourselves out of much of the damages we may now get), are countered by Everton's continued/renewed interest in him as a suitable manager at Goodison Park.

    * I believe that by doing this Everton have placed themselves at great risk. The PL asked our two parties to sort the matter out privately, and if all Everton did was offer a derisory amount with the intention of forcing the governing body to sort the matter out for them, then it seems very likely that some sort of punitive element may be included in any final decision.

    This all lies on 2 things as we all know.

    1). Do we have evidence that Silva was in contact with Everton whilst under contract with us? And if so, how strong and regular was that contact - how far did it go?

    2.) Can we trust the PL to be strong enough on this if the the answer to question 1 is yes on all counts?

    I’m increasingly of the fear that the PL aren’t taking this seriously given they let Liverpool off the hook last year just because they apologised to Saints over VVD. And they have already given Everton the opportunity to pay their way out of the issue. I think it’s fair to assume that they don’t take these things that strongly and I suspect there’s a real chance Everton could get away with this.

    I don’t really care either way what happens at this point. Everton have really gone down in my estimation, they were a team I used to actually quite respect but not anymore. Pretty scummy way of doing business really.

    It’s a shame as they probably would have been a good market for some of our players over the next couple of years looking to make the jump to a bigger club. I expect the pozzos will tell them where to stick their cash in the future.

    Gino is a businessman. He will likely take their money still in the future if it’s more than anyone else is offering. The thing about that however is that whilst they have a richer history and bigger fan base, there can be no guarantee of them being a better club than any of the others outside the Top 6 right now. If clubs such as Newcastle, Villa and I’d even say Stoke can go down, Everton, although unlikely, aren’t immune from a slide down the table. Their recruitment last summer cost a fortune and was an utter disaster. If the repeat that trick, they will be bang in trouble.

    Can’t see any of our players being desperate to make a move to that club right now. Not any players I’d be concerned losing anyway.

  14. Regarding point 1:

    If Everton did not tap him up, why did they offer compensation? Why did Everton make a counter claim that we tapped up Sliva at Hull?

    Also, the Times article states that "Watford’s position is that Silva’s negotiations with Everton constituted a breach of contract."

    I don't expect anyone to accept that as absolute proof, but I think it would be very na*ve not to consider it at least the strongest possibility.

    And regarding point 2, the PL will be very much made aware that Gino still has the option of going through the courts, who cannot punish Everton in football terms, but can still instruct them to pay reasonable compensation above any unsatisfactory amount specified by the PL. I don't think the PL would want that.

    FML, if this tosser is in any way representative of EFC, Silva really will feel right at home.

    It would be interesting to have a poll on exactly how badly Gino rapes Moshiri if they do sign Silva.

    I reckon about £8m. Don't think there will be a points deduction.
