Bournemouth To Discuss Legal Challenge After Premier League Relegation

    I suspect they would just have to prove it contributed to it, not that it caused it. That doesn't mean they'll be due hundreds of millions in lost income or whatever. But it might get them a nice cheque for £5m-£10m - and who would say no to that?

    But then if they were to win in any form then surely this would open up the floodgates to clubs taking legal action against any and every VAR decision (I know this wasn't a VAR decision, but that technology was supposed to remove all doubt and has done anything but) that has proven to be undeniably wrong in hindsight and that has cost them in some way throughout the season/any season going forward?

    There is nothing wrong with VAR it's the ******* idiots who are running it :mad:

    Whereas in the Hawk Eye case, it was a FAILURE of machinery which has been a major cause, if not THE CAUSE, of Muff losing their PL status. which is a whole other kettle of fish :rolleyes:

    It doesn't matter, the end result is that whether it's an irrefutable failing of VAR (and thus the officials running it) or a failing of the Hawkeye goal line technology, the end result is the same - the wrong decision is made when there is no real excuse anymore for it to have been and one team is wrongly done by and loses out.

    If Bournemouth do pursue this and win then it will likely open up a can of worms and empower more clubs to make more legal challenges because of singular decision that may have played a part in whatever failure their season turned out to be, despite the thousands of other variables.

    I agree with your 2cnd point however regarding your first I would say changing the "handball" rule is a major bone of contention regarding VAR . Also some decisions are not black or white they are open to opinion or interpretation . Anything that is opinion should be left in the hands of the referee.

    I can't see the football authorities settling out of court if they think, as many of us do, that Bournemouth don't stand much chance of winning the case.

    GLT and VAR was sold as putting an end to injustices. To my certain knowledge no one said that it might not work. Which is the cop out statement after the Sheff U goal debacle. Because no one would have accepted the introduction of technology and the disruption to the game and the rule changes.
    What happens if it fails again ? Do we just shrug our shoulders and accept the new normal?
    Let's not beat about the bush it technology failed in the WC final and it has influenced a relegation from the Premier div . Is it worth it ?

    There's not much doubt that it contributed to it, is there? After all, it gave Villa a point which they would not otherwise have had, which was eventually the difference between the sides. Surely the question, if you remember your tort law, is whether the link between the error and the outcome is broken by one or several novus actus interveniens?

    I don't agree Nath, the Hawk Eye thing is totally different to the other things you are talking about. It is an equipment failure when all the rest are a matter of someones personal opinion.

    That's the point. The Hawkeye error was not equipment failure. A lot of people are under the impression that Hawkeye is an absolutely foolproof system which can never go wrong, can never be unsighted, can never make a mistake, can never be confused or uncertain. It isn't. Hawkeye is a system which was brought in to improve the chances of goalline decisions being made correctly but it is not, and has never claimed to be, infallible. It it really possible to claim that a system is not fit for purpose, that it is such a hopeless system that fitting it amounts to negligence, when it has been shown to fail 1 time in 9,000 matches?

    The Hawkeye failure to detect the goal was the result of a system trying to find a solution for a problem that was too hard for it. The PL and Hawkeye made all reasonable attempts to get it right and on this occasion weren't quite good enough. The law doesn't punish people when their reasonable attempts aren't good enough.

    Hawkeye will fail very very occasionally.

    Better to accept this and allow refs to ask VAR to have a look if he really thinks it was obviously over the line in a crowded goalmouth.

    The rules preventing it from being double- checked by VAR are ridiculous and need amending imo.

    For VAR not awarding it - that's a case of "the ref got it wrong". He had about 20 seconds to decide what to do, he dithered, he didn't stop play. Human error. VAR showed the pictures just fine.
    For the rules preventing it being awarded - they don't. The rules are perfectly clear that the ref has the final say and also that VAR can be used for all goal situations.

    I don’t care what the rules are, or the process. The officials operating VAR would’ve seen it was a goal, that they didn’t alert the ref to this, or that they did and the ref did nothing is a catastrophic failure.

    We have been told that Hawkeye failed because. Reasons.
    What happens if it fails again ?. Will players start surrounding
    referees after every goal line decision because they have no faith
    in the system.
    And how do we know , for sure , that it hasn't failed before ?

    It isn't a plot, thick or otherwise.

    This Hawkeye system had always worked with no controversy or doubtful decisions and referees trusted it implicitly. On this occasion, although both referee and linesman thought it looked like the ball had gone in, Hawkeye said it hadn't and they trusted Hawkeye above their own judgement. The VAR ref saw that it looked like it might have gone in but this was an unprecedented situation with no proper protocol laid down and he dithered about what to do. Play carried on, the ball went quickly out for a throw-in (subject to my memory being correct, but it went out of play quickly, of that I'm sure). Play was restarted, and it was too late to do anything about it.

    You'd be amazed at how many people can be fooled all at once by the same thing. I was at a match once where Burnley's Chris Vinnicombe was booked in the first half. In the second half, Vinnicombe was booked again, but not sent off - the ref misread his own notebook and thought he'd booked Gerry Harrison in the first half. The point being, that I thought Vinnicombe had been booked twice, so did the man next to me, and also present were 2 linesman and a fourth official, 11 York players plus subs, the york manager and other officials, and 7,000 in the crowd - and pretty much all of them were willing to disbelieve their own eyes and memory and assume the ref was right. It would be like that with Hawkeye. By the time the various officials had got their heads round the idea that the trusted machinery was wrong and they were right, it was too late.

    Next time it happens, they will be prepared and will know what to do.

    I wonder if this isn't just Bournemouth trying to put pressure on officials in the championship who might make 50/50 decisions.
    It might mean subconsciously they lean to Bournemouth as they might fear a backlash if wrong.
    No doubt a bad decision was made but perhaps they are turning it to their advantage.
    How many penalties next year for plucky Bournemouth then?

    There are too many variables in football, the incident wasn’t in the last minute of the game and although unlikely Vila could have gone on to get something from the game regardless. We’ll never know and for that reason how can you take legal action?
